What are 'Requests for Admissions'?

So this is our third video on discovery and discovery tools. And in this video, we're going to be talking about request for admissions. Request for admissions are requests to an opposing party to agree that a certain fact or facts are true. The reason why attorneys use request for admissions in the discovery process, in any type of civil case, but also in particular in divorce cases is because what that does is it streamlines the issues for trial. This can be important if you're working with an attorney because by streamlining those things, by getting those admissions, it means that your attorney is not going to have to go through and present a lot of evidence that the other side might very well have simply agreed to, and say yes, that fact is true, or not going to require you to come and put a bunch of evidence on about that. We're just all going to agree, yes, that's the case. So that's how request for admissions are used. 

One of the things that is especially important about request for admissions, like all discovery tools that we've discussed up until this point interrogatories request for production and request for admissions, the opposing party does have to respond within 30 days. This is especially important when we're dealing with request for admissions because if the other party fails to respond within 30 days, then the things that are requested are deemed admitted. In other words, at that point, you can't contest it. So, if there are requests for admissions that are either untrue or that for any one of a number of legal reasons you would not admit to in a request for admission. Those things can become very damaging to your case. So it's critically important that responses to those be timely filed. 

So in our final video regarding discovery and discover tools, we're going to talk about something that you don't see as often as some of the other tools but it is still a very, very important part of any discovery in any sort of divorce case and that is a deposition. So we're going to talk about that in our next video.
