One of the things that we do a lot of here is help parents establish parenting relationships through the legitimation and paternity case process. One of the questions that I frequently get is whether or not a mother is entitled to back child support. Under the current Georgia law there is no provision allowed for back child support for a child. Child support is always a prospective proposition, however there is an exception to that rule and it’s called past due expenditures.

What that has to do with is allowing a parent to recoup expenditures that they have tracked such as cost related to medical care, the birth of the child, etc. As long as those can be proved with receipts etc. a mother is entitled to request those things from a court that is establishing the father’s parental rights. So a parent can ask that to happen whenever those father’s parental rights are being established.
